Attorney Biography
Attorney Fleming’s practice primarily focuses on litigation, trial, and appellate advocacy in defense of cities, towns, and schools, school districts, and other governmental agencies in Massachusetts State and Federal Court against claims of negligence, premises liability, civil rights, discrimination, and employment matters. Additionally, he represents cities, towns, and other public employers before the Massachusetts Commission Against Discrimination and the Equal Employment Opportunity Commission. He is admitted to practice in the Commonwealth of Massachusetts and the United States District Court for the District of Massachusetts.
Prior to joining Pierce Davis & Perritano LLP, Mr. Fleming was an Assistant Regional Counsel with the United States Department of Health and Human Services where he primarily represented, defended, and advised the Centers for Medicare and Medicaid Services from litigation and appeals by skilled nursing facilities in front of Administrative Law Judges and the Department Appeals Board. Prior to that, Mr. Fleming worked for seven years as an Assistant General Counsel with the Massachusetts Department of Developmental Services, defending the Department at Administrative Hearing, drafting responses to public records requests, subpoenas, and other compulsory legal requests, and researching and writing legal memos in response to tort claims filed against the Department. Mr. Fleming began his legal career working for the Massachusetts Office of the Attorney General where he defended various state agencies in Superior Court against M.G.L. c. 30A complaints in the Administrative Law Division.
