Pierce Davis & Perritano Announces Three New Partners

Pierce Davis & Perritano is pleased to announce that Seth B. Barnett, Jason W. Crotty, and Melissa M. Malloy have become partners in the firm.

 

Attorney Barnett’s practice is centered on litigation and trial advocacy in defense of both public sector and private clients in a broad range of complex cases, including land use, civil rights, tort, contract, education, employment, and environmental, before all levels of the Massachusetts trial courts, the United States District Court (Districts of Massachusetts), the Massachusetts Appeals Court, and the United States Court of Appeals for the First Circuit. In addition, Mr. Barnett counsels clients on general municipal law, licensing, land use and permitting. He regularly handles significant civil rights and First Amendment matters on behalf of local municipalities and officials, which are often of public significance.

 

 

Attorney Crotty’s practice is focused on litigation and trial advocacy in defense of corporations, individuals, governmental subdivisions, and agencies in the Massachusetts State and Federal Courts. Mr. Crotty is also a Mediator, certified in compliance with Massachusetts Supreme Judicial Court requirements. Mr. Crotty’s practice centers on defending municipalities throughout the Commonwealth in a broad range of areas, including defense of public officials and employees in personal injury claims, employment disputes, civil rights litigation, as well as, products liability defense with an emphasis on defending manufacturers and installers of elevators, escalators, and other products and machinery.

 

 

Attorney Malloy’s practice focuses primarily on the defense of asbestos-related toxic tort actions. Ms. Malloy primarily assists in the nationwide defense of an equipment manufacturer in the asbestos litigation. Her work includes the investigation of key facts, the development of expert strategy, the preparation of dispositive and pre-trial motions, and trial preparation and appellate support for federal and state cases filed in jurisdictions across the United States.

 

 


Attorney John Davis to Speak at MCLE 18th Annual Municipal Law Conference 2020

PDP Partner, John J. Davis, will be presenting “Employment Law Update” at MCLE’s 18th Annual Municipal Law Conference on Wednesday, March 25, 2020. 

Mr. Davis is head of Pierce Davis & Perritano’s Governmental Liability and Civil Rights Practice Group. His practice focuses on the defense of cities, towns, and other public employers in suits alleging civil rights violations, discrimination, harassment, negligence, and educators’ and school board liability. He has successfully defended police officers sued for wrongful death and civil rights violations in connection with fatal shootings, high speed pursuits, and suicides by pre-trial detainees; school officials accused of harassment; sexual assault or unlawful discipline of students; and other public officials against allegations of defamation, abuse of process, unlawful license revocation, and wrongful termination.

Attorney John Cloherty to Speak at MCLE 18th Annual Municipal Law Conference 2020

PDP Partner, John Cloherty, will be presenting “First Amendment Update: Signs, Panhandlers, Public Meetings” at MCLE’s 18th Annual Municipal Law Conference on Wednesday, March 25, 2020. 

Mr. Cloherty has represented numerous individuals, corporations, municipalities, schools and school districts, and other governmental agencies in defense of negligence, motor vehicle torts, products liability, premises liability, negligent security, medical malpractice, civil rights, discrimination, zoning and licensing disputes, and intentional tort claims. He has represented individuals and public employers under the Civil Rights laws of the United States and Massachusetts and Rhode Island, as well as the state and federal anti-discrimination laws. His trial experience includes diverse cases such as First Amendment claims, police misconduct, motor vehicle torts, breach of contract claims, property nuisance, accounting malpractice, and employment discrimination.

Land Court Upholds Bylaw Requiring Solar Energy Facility to Obtain Special Permit

On December 12, 2019, Chief Justice Gordon Piper of the Massachusetts Land Court denied the plaintiff, PLH LLC’s Motion for Summary Judgment on a petition filed under G.L. c. 240, § 14A, challenging the validity of the Town of Ware Zoning Bylaw.  Plaintiff plans to install two large ground-mounted solar energy facilities totaling 8.0 MW on 56 acres in a Rural Residential (RR) district within the Town of Ware.  Under the Ware Zoning Bylaw, such a use in an RR district requires a special permit granted by the Planning Board.  After the Planning Board initially denied the special permit, plaintiff appealed the decision to the Land Court pursuant to G.L. c. 40A, § 17.  The Land Court remanded the case to the Town for a second public hearing, following which the Planning Board ultimately granted the special permit.  Although its Chapter 40A appeal was subsequently dismissed as moot, plaintiff continued to challenge the validity of the special permit requirement on the grounds that the installation of solar energy facilities is a protected use under G.L. c. 40A, § 3; therefore, the special permit requirement (argued PLH) is invalid as an unreasonable regulation.  The Land Court disagreed and ordered judgment to enter in favor of the Town.  Chapter 40A, Section 3 does not, ruled the Court, expressly prohibit the regulation of solar energy facilities by means of  the special permit process, provided the Bylaw is reasonably applied so as to protect the public health, safety or welfare.  Attorney John Davis of PDP represented the Town of Ware in the Land Court action.


Pierce Davis & Perritano Makes Holiday Season a Little Brighter for Massachusetts Children

Each year Pierce Davis & Perritano LLP participates in an annual Toy Drive organized through the Massachusetts Department of Children and Families (DCF). The toy drive makes the holiday season a little brighter for children living in foster care, state-run residential facilities and impoverished homes in Massachusetts.

PDP employees, as well as their family members and friends, who elect to participate in the program receive a child’s name along with a wish list for toys, clothes, activities, athletic equipment, books or games that they may want for the holiday. We are honored to be able to help fulfill the wishes of these very deserving children.

The firm sponsored 80 children, making this year one of our largest seasons of giving. Thank you to everyone who participated in this year’s Toy Drive, and a special thanks to Melissa M. Malloy for spearheading the program at PDP for a 4th consecutive year.

About Melissa M. Malloy:

Melissa M. Malloy focuses her practice on the defense of toxic tort actions. For the past eight years, as a member of a National Coordinating Counsel team, she has assisted in the nationwide defense of an equipment manufacturer in the asbestos litigation. Her work includes the investigation of key facts, the development of expert strategy, the preparation of dispositive motions, and trial preparation and appellate support for federal and state cases filed in jurisdictions across the United States.

Ms. Malloy previously served as an appellate law clerk to the Chief Justice of the Supreme Court of the U.S. Virgin Islands for three years.  She is currently a member of the Defense Research Institute.  She is admitted to the state bars of Massachusetts and Rhode Island, the U.S. District Court for the District of Massachusetts, and the U.S. Supreme Court.
